Article 1 – This contract concerns the rental of a cottage in the Domaine Casagrande, located Hameau Mourèdes, 07140 MALBOSC.

Article 2 – length of stay: The tenant signatory of this contract concluded for a fixed term will in no circumstances be able to claim any right to prolong the stay out of the period previewed in the contract.

Article 3 – Conclusion of the contract: The reservation becomes effective when the tenant has sent to the owner the deposit indicated and a copy of the contract signed before the date indicated. A second copy is to be kept by the tenant.

The lease concluded between the parties to this deed can in no way benefit even partially to third parties, natural or legal persons, except with the written agreement of the owner.
Any breach of this last paragraph could result in the immediate termination of the lease to the fault of the tenant, the proceeds of the lease remaining permanently acquired from the owner.

Article 4 – cancellation by the tenant: Any cancellation must be notified to the owner, with acknowledgment of receipt.

a) cancellation before arrival on the premises:
the deposit remains acquired to the owner. The latter may request the balance of the amount of the stay, if the cancellation occurs less than 30 days before the date of entry into the premises when the rental concerns several lodgings. This period is reduced to 15 days if the rental concerns one cottage.

If the tenant does not appear within 6 hours of the date of arrival indicated on the contract, this contract becomes void and the owner can dispose of his lodging. The deposit is also acquired to the owner who will ask the balance of the rent.

b) if the stay is shortened, the price of the rent remains acquired to the owner. There will be no refund.

Article 5 – Cancellation by the owner: The landlord pays the tenant the full amount paid in advance.

Article 6 – arrival: The tenant must appear on the day specified in the time slot mentioned on this contract. In case of late or delayed arrival, the tenant must notify the owner.

Article 7 – payment of the balance: The balance of the rent is paid at least 7 days before the rental start date in case of rental of several lodgings.

This deadline is brought back at the latest on the date of entry in the places in case of renting a lodging.

Article 8 – inventory: An inventory is established in common and signed by the tenant and the owner or his representative on arrival and departure from the Domaine Casagrande. This inventory is the only reference in case of litigation concerning the inventory.

The state of cleanliness of the lodging (lodgings) on the arrival of the tenant will have to be noted in the inventory of fixtures. The cleaning of premises and all the cooking elements made available in normal use is the responsibility of the owner. In case of abnormal use of the premises and / or all the cooking elements made available, or exceptional soil, the amount of the cleaning fee will be re-invoiced to the tenant.

The tenant is responsible for keeping cottage clean otherwise he will be billed for the cleaning costs of € 50 to € 100 depending on the state of the gîte when the tenants leaves.
The cleaning of sheets and towels rented by the owner is the responsibility of the owner.

Article 9 – deposit or guarantee: On arrival of the tenant, a deposit of the amount indicated on the contract is requested by the owner. After the contradictory establishment of the inventory of place during departure, this deposit is restored, deduction is made on the deposit if degradations in stay place were noted.

In case of early departure (prior to the time mentioned on this contract) preventing the establishment of the inventory on the same day of the departure of the tenant, the deposit is returned by the owner within a period not exceeding 15 days in the absence of damage. This period is increased to 2 months in case of damage found.

Article 10 – use of the premises: The tenant must ensure the peacefulness of the rented place and use it according to the usage destination of the place.

Article 11 – Capacity: This contract is established for a maximum capacity of 12 guests in case of renting the entire estate (all cottages) and 2 guests for the “Belle de Nuit” cottage, 4 guests for the “Half-Half” cottage – additional extra beds can be discussed in advance on a case-by-case basis. If the number of tenants exceeds the capacity, the owner can refuse the additional persons. Any modification or breach of the contract will be considered at the initiative of the customer.

Article 12 – animals: This contract specifies that animals are not allowed. In case of non-respect of this clause by the tenant, the owner can refuse the stay. In this case, no refund will be made.

Article 13 – Insurance: The tenant is responsible for all damages arising from his act. He is required to be insured.

Article 14 – Payment of charges: The charges for water and electricity are included in the rental price, for normal use. In case of abnormal use, the charges may be invoiced to the tenant.

Article 15 – disputes: Any claim relating to the rental will be treated by the competent Court namely the Court of Nimes.
